APR planning tips
- Character appropriate test: Farmhouses must be proportionate to the farming operation. Courts look at the scale of land farmed and farming activity. Oversized or luxuriously converted farmhouses risk partial or full refusal of APR.
- Use Farm Business Tenancies (FBTs): If letting land to a tenant, grant tenancies under the Agricultural Tenancies Act 1995 (FBT) rather than old Agricultural Holdings Act tenancies. FBTs attract 100% APR; AHA tenancies are restricted to 50%.
- April 2026 — act now: The combined APR+BPR £1M cap at 100% (excess at 50%) fundamentally changes estate planning for larger farms. Review succession structures, consider gifting, and explore trusts before April 2026.
- Development value: APR applies to agricultural value only. Obtain a professional Red Book valuation to separate agricultural value from any development hope value — the difference is subject to IHT at 40%.
- Lifetime gifts and PETs:Gifting agricultural property during your lifetime starts the 7-year PET clock. APR and BPR can still apply to chargeable PETs if the recipient still holds qualifying property at the date of the donor's death.
