How Employment Tribunal Awards Are Calculated

A successful claimant in an unfair dismissal or discrimination case can receive up to three types of award:

Basic Award

Calculated identically to statutory redundancy pay — based on age, years of service (up to 20), and weekly pay (capped at £643 in 2024/25). Multipliers are 0.5× for years under 22, 1× for 22–40, and 1.5× for 41 and over.

Compensatory Award

Covers actual financial loss: lost earnings, future loss, loss of benefits. Capped at the lower of 52 weeks' actual pay or £105,707 (2024/25). No cap applies to most discrimination claims.

Injury to Feelings (Vento Bands)

Available in discrimination cases only. The Vento guidelines (updated 2024) set three bands:

  • Lower band £1,100–£11,200 — isolated or one-off acts
  • Middle band £11,200–£33,700 — serious cases not meriting the upper band
  • Upper band £33,700–£56,200 — most serious, including employer-condoned discrimination

Reductions

Tribunals can reduce awards for contributory fault (employee's own misconduct), failure to follow ACAS Code, or Polkey reductions where the employer could have fairly dismissed had they followed the correct procedure.
